These Terms of Service ("Terms") govern your use of the MentionDrop website and service at www.mentiondrop.com ("Service"), operated by MentionDrop ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

MentionDrop is a web mention monitoring service that tracks keywords and topics across the internet and delivers real-time notifications with AI-powered summaries. The Service is provided on a subscription basis with both free and paid plans.

2. Account Registration

To use MentionDrop, you must create an account using Google OAuth. You are responsible for maintaining the security of your Google account and for all activity that occurs under your MentionDrop account. You must provide accurate information and promptly update it if anything changes.

Each person or entity may only create and maintain one MentionDrop account. Creating multiple accounts to circumvent plan limits, keyword restrictions, or other Service limitations is prohibited and may result in suspension or termination of all associated accounts.

You must be at least 16 years old to create an account. By registering, you represent that you meet this age requirement.

3. Subscription Plans and Billing

Free Plan

The free plan provides limited access to the Service at no charge. Free plan features and limits may change at any time without notice. Free plan mention data is retained for 7 days.

Paid Plans

Paid subscriptions (Starter and Pro) are billed on a recurring basis through Stripe. By subscribing, you authorize us to charge your payment method at the beginning of each billing cycle. Prices are displayed at checkout and may be updated with 30 days' notice.

Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date. We do not provide prorated refunds for partial billing periods.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Use the Service to monitor, stalk, harass, or harm any individual
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated tools (bots, scrapers) to access the Service outside of our provided API
• Resell, redistribute, or sublicense access to the Service without our written consent
• Create multiple accounts to bypass plan limits or keyword restrictions
• Interfere with or disrupt the Service or impose unreasonable load on our infrastructure

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on the severity of the violation.

5. Fair Use

MentionDrop is designed for monitoring brands, companies, products, personal names, and other specific topics that you intentionally want to track across the web.

Each keyword you add must represent a brand, company, product, person, or another defined topic that is relevant to your monitoring needs.

We may disable keywords that do not align with this intended use, including generic phrases, job searches, or high-volume common terms that are not suitable for the Service.

Before disabling an unsupported keyword, we will notify you by email and give you 24 hours to update or replace it.

6. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by MentionDrop and protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

You retain ownership of any keywords, configurations, or other content you provide. Web mention data surfaced by the Service originates from third-party sources and is presented as-is for informational purposes.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the practices described in the Privacy Policy.

8. AI-Generated Content

MentionDrop uses AI models to generate summaries and analysis of web mentions. This AI-generated content is provided for informational convenience and may contain inaccuracies. You should verify important information independently. We do not guarantee the accuracy, completeness, or reliability of AI-generated summaries.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

10. Limitation of Liability

To the maximum extent permitted by law, MentionDrop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.

12. Indemnification

You agree to indemnify and hold harmless MentionDrop and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice within the Service at least 30 days before taking effect. Your continued use of the Service after changes are effective constitutes acceptance of the revised Terms.

14. Termination

You may terminate your account at any time by contacting us or using the account deletion option in your settings. We may terminate or suspend your access at our discretion if you violate these Terms. Upon termination, your right to use the Service ceases immediately, and your data will be deleted according to our Privacy Policy.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of England and Wales.
